MEMORANDUM OPINION AND ORDER
ARRAJ, District Judge.
This matter comes before me now on plaintiff’s motion to dismiss defendants’ counterclaim. Briefs have been filed and neither party has requested oral argument. This case is one of two fiercely contested lawsuits involving plaintiff’s efforts to obtain migrant labor for seasonal work in the western Colorado fruit orchards. See Jones v. Edwards, Civ.
