STACY, C. J., and BARNHILL, J., concur in dissenting opinion. This was a civil action for the foreclosure of street assessment liens, under C. S., 7990, on eight lots in the city of Raleigh, described in the pleadings, now owned by the defendant.

It was admitted that the proceedings for the assessment on the described lots of the apportioned cost of the local improvements were sufficient to subject said lots to a lien in favor of the plaintiff therefor, in accordance with the statutes.
