McNAMARA, District Judge.

Before the court is the Motion to Remand of Mary P. Booty and Wilton L. Booty, (“plaintiffs”). Shoney’s, Inc. (“Shoney’s”) opposes the motion. This motion, which was set for hearing on January 4, 1995, is before the court on briefs, without oral argument.

BACKGROUND

This litigation arises out of an alleged slip and fall in a Shoney’s Restaurant which occurred on or about July 28, 1993. Suit was filed in the 22nd Judicial District Court, Parish of St. Tammany for the State of Louisiana on July 26, 1994, and was served on Shoney’s on August 10, 1994. Answers to…
