Appellants Doran and Ruth Ann Syler appeal a summary judgment of the Tuscarawas County Common Pleas Court in favor of appellee Signode Corporation.

“Despite appellants’ filed affidavits and deposition transcripts which submitted sworn statements of fact witnesses, parties, and appellants’ engineering expert and which placed material factual and legal matters at genuine issue, the trial court erred by sustaining appellee’s dispositive motion for summary judgment.”
