BARD, District Judge.

This is a motion to dismiss the action or, in lieu thereof, to quash the return of service of summons under the Federal Rules of Civil Procedure, rule 12(b), 28 U.S.C.A. folloxving section 723c. In an opinion filed August 13, 1945, 4 F.R.D. 478, I deferred determination of this motion for a period of thirty days because there were insufficient facts before the court to determine the motion on its merits, granting leave to the parties to place additional facts on the record in a manner not inconsistent with the Federal Rules of Civil Procedure.
