Plaintiff in error, to whom we will refer as the executor, is here on writ of error to review a judgment of the probate court of the City and County of Denver allowing two claims filed by the Department of Welfare in the estate of Allie Perry Arthur, deceased.

The first claim was based upon the fact that the deceased, who was an old age pensioner, failed to disclose that she held title to the property in which she lived, and that by reason thereof no net rental value was deducted from the maximum old age pension grant to which she was entitled, during the period from November 1947 through…
