delivered the opinion of the court:

Plaintiff in error, William E. Fisher, filed a bill in the circuit court of Macon county against defendants in error, Charles A. Burks and Edith R. Burks, husband and wife, for a re-conveyance of certain lands under an agreement. The cause was referred to the master in chancery, who heard the evidence and reported his conclusions of law and fact and recommended that the bill be dismissed for want of equity.
