The appellees claim that the contract of September 17, 1895, here in controversy, was executed for the purpose of compensating them for the damages, which they expected that their land, fronting on Cheltenham Place, would suffer from the laying down of the tracks of the Calumet Electric Street Railway Company upon said place.
