This matter is before the court on defendant’s motion for summary judgment. Based on a review of the file, record and proceedings herein, and for the reasons stated, the court grants defendant’s motion.
BACKGROUND
In July 1997, plaintiff Jack McCord (“McCord”) filed this action in Louisiana State Court against defendant Minnesota Mutual Life Insurance Company (“Minnesota Mutual”) and one of its insurance sales agents, Earl Venable (“Venable”). 1 On August 22, 1997, defendants removed this case to United States District Court in the Western District of Louisiana.
