BUNN, District Judge.

This is an action to recover upon a policy ,of life insurance. A jury was Waived in the trial court, and the cause tried by the court, who made the following finding of facts and conclusions of law:

'(1) On March 5, 1896, the defendant, the Nederland Life Insurance Company, Limited, issued its policy of insurance for five thousand dollars to William Meinert, payable upon his death to his wife, Mary Meinert, the plaintiff herein, a true and correct copy of which said policy of insurance is filed with the complaint, and is made a part thereof, under and pursuant to the…
