The Williams & Miller Gin Company, a corporation, as plaintiff, sued the Baker Cotton Oil Company, a corporation, as defendant. Plaintiff’s cause of action was predicated upon the destruction by fire of its gin planlfc, certain cotton, cotton seed and supplies, by fire alleged to have been negligently caused by the defendant. The defendant pleaded the general issue, contributory negligence, that plaintiff had been paid by an insurance company the full amount of the value of the property destroyed, and by way of supplement to its answer, further pleaded a state of facts in…
