This was an action for damages for personal injuries, commenced by the defendant 'in error, plaintiff below, against the plaintiff in error, defendant below. The injuries for which damages are claimed were inflicted upon the plaintiff at the intersection of Hudson street and a spur or industrial track of the defendant company in Oklahoma City. This spur leaves the main line a few blocks west of Hudson- street, and terminates about a block and a half east thereof'between Harvey and Robinson streets.
