I. Procedural Background
On January 20, 1983, Michigan Interstate Railway Company (Railway) filed a petition for a railroad reorganization under Ch. 11 of the Bankruptcy Code. As of the petition date, there were two pending suits previously filed in the U.S. District Court for the Eastern District of Michigan by various railway unions representing employees of the Railway.
