Appeal by the clerk of the comity of Erie from an order of the Superior Court of the city of Buffalo,.entered in the office of the clerk of said court on the 25th day of October, 1895, requiring him' to receive and file certain certificates of nomination of certain persons for ward offices in the city of Buffalo, and reversing -the decision of said county clerk, that said certificates were not entitled' to be filed.

The general election for this State, in 1895, was held on the fifth day. of November. On the 25th of September; 1895, the Democratic party, at a State convention duly.held, nominated candidates for State officers to be voted for by the electors of this State, and selected a star as the emblem to designate the candidates of such party, and a certificate of such nominations, with a representation of the emblem, was duly filed in the office of the Secretary of State.
