The complaint in this case showed, in substance, the following facts: On the 31st of August, 1872,, John R. Stuart executed to Moses Carithers five promissory notes, one for $500, and each of the others for $1,000, due respectively in one, two, three, four and five years after date; at the same time said John R. Stuart and his wife, Martha B. Stuart, who is the appellee, to secure said notes, executed to said Carithers a mortgage on certain real estate owned by'said John R.
