PROCEDURAL BACKGROUND

Margaret Lukasik, Kenneth Lukasik, Christina Lukasik, and the estate of Jacob Lukasik (Lukasiks) filed suit against San Antonio Blue Haven Pools, Jody Carpenter, and Beto Garcia (Blue Haven defendants) alleging causes of action for wrongful death, negligence, gross negligence, and violations of the DTPA arising out of the drowning of Jacob Lukasik.
