In this case the facts are found and rest chiefly on documents. The only question in the case which is of any special importance is whether a sale of lumber made by W. F. & G. W. Turner to John J. Foster & Co. passed title to 100,000 feet of mill culls replevied in this suit.

On August 17, 1887, W. F. & G. W. Turner owned 125,000 feet of pine mill culls, piled up at Dixon’s siding, in piles marked “Mill Culls,” but containing more or less other lumber. On that day the Turners sold to Foster & Oo. by absolute bill of sale, and for payment made at the time, 100,000 feet of mill culls, at $5.50,…
