Defendant appeals by leave granted an order entered in the Recorder’s Court for the City of Detroit denying his motion to dismiss the charges against him on the basis of the principles of res judicata and double jeopardy. We affirm.

In September 1989, defendant was charged with two counts of first-degree criminal sexual conduct (esc), MCL 750.520b; MSA 28.788(2). At the time the offenses were allegedly committed, defendant was on probation for a previous conviction of carrying a concealed weapon.
