MEMORANDUM-DECISION AND ORDER
HOMER, United States Magistrate Judge.
On May 17, 1996, a judgment was entered in this district in favor of plaintiff Liberty Mutual Insurance Company (“Liberty Mutual”) against Fort Ann Express, Inc. (“Fort Ann”) in the amount of $178,500. After Fort Ann filed a petition in bankruptcy, Liberty Mutual commenced the two above captioned consolidated actions to hold defendant Leroy Holding Company (“Leroy Holding”) liable for the judgment of $178,500 and to subordinate the bankruptcy claim of Leroy Holding to that of Liberty Mutual.
