Introduction

On September 4, 1997, Janice Parker (“Parker”) filed a complaint against the State of Delaware Department of Public Safety (“the Department” or “DPS”) alleging violations of Title VII, 42 U.S.C. § 2000e et seq. 1 and 42 U.S.C. § 1981, 2 as well as violations of state law. The Title VII based counts alleged disparate treatment, a hostile work environment, and retaliation. The § 1981 claim was based on an alleged failure to promote.
