Virginia A. Scott, the defendant in error, brought suit in the Supreme Court against the Consolidated Traction Company, the plaintiff in error, in tort, for damages resulting from the death of her son, William Scott, a boy aged seven years and eight months, caused by being run over by a *684trolley car of the defendant below, in the city of Bayonne, on the 9th day of October, 1894, The suit was brought by the mother as administratrix of the sou, for the benefit of the next of kin under the statute.
