This action involves agreements between the brand-name manufacturer of the widely used antibiotic ciprofloxacin hydrochloride (“Cipro”) and potential generic manufacturers of Cipro. The brand-name manufacturer, Bayer AG, a German company, and its American subsidiary, Bayer Corporation (collectively, “Bayer”) and the generics, Barr Laboratories, Inc.
