The plaintiff, Hiram M. Colwell, instituted two actions against Kenneth G. Nygaard, seeking recovery of damages suffered by reason of the death of plaintiff’s minor daughter, Edith F. Colwell, who died January 3, 1940, as the result of injuries which she received four days previously, when she was struck by an automobile owned and operated by defendant. In one action plaintiff sued individually; in the other as administrator of his daughter’s estate.
