Plaintiff filed an amended complaint in this action on March 20, 2007 (Item 5) alleging that defendant terminated her employment and discriminated against her based upon her age in violation of the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621, et seq. In lieu of an answer, defendant filed this motion seeking dismissal of the amended complaint and for an order compelling arbitration pursuant to Fed.R.Civ.P. 12(b) and the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16 (Item 9).
