{¶ 1} Plaintiff-appellant, Michael Foulke, appeals the judgment of the Marion County Court of Common Pleas granting summary judgment in favor of defendant-appellee Jonathan Short.

{¶ 2} On August 28, 2001, Short drove his pickup truck on a two-lane residential street in the city of Marion. Short observed an ice-cream truck parked in a no-parking zone along the right side of the road. Short also noticed a pickup truck parked opposite the ice-cream truck along the left side of the road.
