— This cause was tried in Graham county before a jury on April 25 and 26, 1921. The action is for damages alleged to have been suffered by plaintiffs by reason of an injunction sued out in a certain action in which Eichard Y. Dey was plaintiff and appellants above named were defendants. The appellees, plaintiffs in the court below, were lessees of Richard V. Dey. They had a written lease which permitted them to enter upon, take possession of, and work certain mines situated in Graham county, known as the Grand Eeef mines.
