Action in the district court for Meeker county to recover $15,000 for personal injuries. In its answer defendant alleged that plaintiffs injuries were caused by her own negligence in not exercising care to ascertain whether trains were approaching. The reply was a denial of that allegation. The case was tried before Powers, J., who. denied defendant’s motion for a directed verdict and a jury which returned a verdict in favor of plaintiff for $1,500. Erom an order denying defendant’s motion for judgment notwithstanding the verdict or for a new trial, it appealed.

Action to recover damages for personal injuries sustained by the plaintiff, in colliding with one of the defendant’s trains on October 28, 1910, at a street crossing in the city of Litchfield, and in which she obtained a verdict for the sum of $7,500. This is an appeal by the defendant from an order denying its alternative motion for judgment in its favor or for a new trial.
