HULEN, District Judge.

Plaintiff’s action is for damages for personal injury based on negligence of defendant. The sole allegation of negligence (and injuries) in the complaint, after stating defendant was operating an automobile and plaintiff was a pedestrian, is: “ * * * defendant negligently caused *and permitted said automobile with great force and violence to strike and collide with plaintiff, whereby plaintiff was caused to sustain serious and permanent injuries, due as a direct *562and proximate result of the negligence of the defendant, * * * ”
