The defendant, Franklin McLaughlin, appealed from his conviction of murder in the second degree. In an unpublished memorandum and order pursuant to its rule 1:28, the Appeals Court affirmed the conviction. Commonwealth v. McLaughlin, 48 Mass. App. Ct. 1116 (2000). We granted the defendant’s application for further appellate review. The defendant claims that the judge erred in (1) his instructions to the jury on manslaughter; and (2) his exclusion of the *559defendant’s statement to the police.
