Affirming.

About August, 1922, Fred Collins became tbe owner of forty acres of the Harrison-Shannon oil and gas lease in Warren county. Tbe Palmer Corporation owned fifty acres of tbe same lease adjoining tbe forty acres owned, by Collins. There were ten producing wells on Collins’ forty acres and a number of wells on the other fifty acres, Wells bad been put down within 130 feet of tbe division line between them.
