Introduction
This pre-award bid protest action comes before the court on plaintiff’s motion to permanently enjoin the Department of Energy (DOE) from awarding a contract for the systems engineering, development, and management of the nation’s first nuclear waste repository' (the SEDM contract). Plaintiff, TRW Environmental Safety Systems, Inc. (TESS), was an unsuccessful bidder on the SEDM contract, which is worth more than one billion dollars over the next 10 years and includes an option to renew for an additional five years.
