MEMORANDUM OPINION

WALTON, District Judge.

This matter comes before the Court upon the defendant’s motion to dismiss the plaintiffs complaint pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure, or in the alternative for summary judgment and the plaintiff’s cross-motion for summary judgment. Upon consideration of the parties’ submissions, the court' will deny the defendant’s motion to dismiss, grant in part and deny in part the defendant’s motion for summary judgment, and also grant in part and deny in part the plaintiffs motion for summary judgment.
