We hold in this ease that the failure of Plaintiff-Appellee State of Hawai'i (the prosecution) to disclose an alibi-rebuttal witness was a violation of Hawai'i Rules of Penal Procedure (HRPP) Rule 12.1, 1 even though the witness had been previously listed as the alibi witness of Petitioner/Defendanh-Appel-lant Brandon Valeros (Defendant), but apparently unbeknownst to Defendant became the prosecution’s witness. Hence, in the absence of a showing of good cause under HRPP Rule 12.1(f) for granting an exception to the requirements of HRPP Rule 12.1, it was error…
