MEMORANDUM ORDER DENYING PLAINTIFFS’ MOTION TO AMEND THE COMPLAINT

In this action on remand from the Second Circuit, Plaintiffs have moved, to amend the complaint to include claims under the Employee Retirement Income Security Act of 1974, as amended (“ERISA”), 29 U.S.C. §§ 1001 et seq., seeking certain employee benefits from Defendant CPC (hereinafter “Bestfoods”) 1 and its sponsored benefit plans.
