The appellant, R. L. Browning, was plaintiff, and the appellee, F. C. Beck, defendant, in the court below, and for convenience we will designate the-parties as in the trial court.

Plaintiff brought this suit against the defendant in the district court of Harris county to recover damages for personal injuries sustained by him on the evening of April 30,1931, when he was struck by an automobile being operated by the defendant on the Houston-Wharton public highway.
