BROWN, Associate Justice.

In the city of San Antonio the railroad of the plaintiff in error crosses West Commerce street at right angles,- the line of the railroad running north and south at that point. There were a number of tracks at this point, and between two of them there was erected, near the crossing of the street on the north side of it, a switchman’s house, and some ties piled, so that by these obstructions one who approached the main track from the west could not see an approaching engine and tender until upon or nearly upon the track.
