Pennington v. Town of Sumner

-An appeal in a case, which apparently involved the same parties as in this case, was before this court hitherto, and the opinion in that case may be found in 217 Iowa 1117, 253 N. W. 60. Following the decision in that case the town of Sumner called a new election, at which it again submitted to the electors the proposition of the establishment of a municipal light and power plant. A majority of the votes at such election were in favor of such proposition, and thereafter the town called for bids and entered into a contract with Fairbanks-Morse Construction Company for the erection…
