This action was bi’ought by the plaintiff for an account and settlement with the defendant of transactions between them continuing through a number of years, and for judgment. Owing to the blanks in the pleadings, we are not able to tell just when these transactions commenced ■or ended. But from the statement in the record, they must have commenced as early as 1881 or 1882, and continued until 1888.

The action was commenced in October, 1891, and at December Term, 1891, there was a reference to W. R. Allen to take and state an account. This order was apparently a consent order.…
