WEATHERBEE, Justice.
The matter is an appeal from the dismissal of a petition for the writ of habeas corpus brought under 14 M.R.S.A. § 5502 et seq. in which Petitioner sought to set aside his conviction in 1960 on separate counts one of which charged grand larceny and the other a prior conviction and sentence to the State Prison.
