George Fox appeals from the denial, without a hearing, of his petition for a writ of habeas corpus. Fox stands convicted upon a jury’s verdict of murder in the first degree and is serving a sentence of life imprisonment. At trial in 1960, appellant-petitioner was *310represented by retained counsel and petitioner did not testify in Ms own behalf.1 No motion for a new trial or in arrest of judgment was filed and there was no direct appeal from the judgment of sentence. On the present appeal, our conclusion is that the petition was correctly denied.
