OPINION

SHORT, Judge.

Katalin Deli seeks to hold the University of Minnesota liable for emotional distress damages arising from its athletic director’s breach of an oral promise not to view a videotape that contained both the University’s gymnastics team performance at a 1992 Florida competition and Deli’s sexual encounter with her husband in a Florida hotel room. On appeal from an award in Deli’s favor, the University argues its legal obligation and the doctrine of immunity preclude Deli’s promissory estoppel claim.
