This is the second time this cause has been before us. In Tevis v. Beigel, 156 Cal.App.2d 8 [319 P.2d 98], we reversed a judgment of nonsuit which terminated the first trial of the action. The second trial resulted in a money judgment against defendants Morris Beigel and Cecil Sills and in favor of plaintiff in his capacity as assignee for the benefit of creditors of Midway Foundry of Gardena, Inc.
