MEMORANDUM OPINION AND ORDER

HART, District Judge.

The ten plaintiffs in this case are all former employees of defendant Lever Brothers Company. Plaintiffs worked at defendant’s Hammond, Indiana plant and all voluntarily retired in 1995, the earliest on May 1 and the latest on October 1. Plaintiffs claim that defendant violated the Employee Retirement Income Security Act of 1974'(“ERISA”), 29 U.S.C. § 1001 et seq., by failing to adequately inform plaintiffs of a voluntary termination package (“VTP”) that allegedly was “under consideration” before their retirement, but did not become available…
