—In an action to enforce an indemnity agreement, the plaintiffs appeal from so much of an order of the Supreme Court, Westchester County (Rosato, J.), entered May 5, 1994, as denied their motion for summary judgment and for ah inquest to determine their attorney’s fees, costs, and expenses.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the plaintiffs’ motion for summary judgment is granted, and the matter is remitted to the Supreme Court, Westchester County, for an inquest to determine the attorney’s fees, costs, and expenses to which the plaintiff is…
