This case arose when plaintiff in error, who was plaintiff in the trial court, sought a temporary injunction restraining the water commissioner of Irrigation District No. 40, Delta county, or any of the other defendants named in the action, from interfering with his right to waste and seepage water collected and used through his irrigation ditches in McKinnon Draw, south of Grand Mesa and north of the Gunnison river, into which stream the whole area of Water District No. 40 drains, and judgment quieting his title to said waters for irrigation.
