MEMORANDUM DECISION AND ORDER

Plaintiff Daniel Maldonado (“Maldonado”) brings this action against defendant Daniel Pharo (“Pharo”) and the United States under the authority of Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388, 91 S.Ct. 1999, 29 L.Ed.2d 619 (1971) 1 for violations of his constitutional rights, and for false arrest, malicious prosecution, and malicious abuse of criminal process, pursuant to the Federal Tort Claims Act (“FTCA”).
