I. INTRODUCTION

This matter comes before the Court on Defendants’ motion for summary judgment re: laches [dkt. 17], motion for partial summary judgment (Counts IV-VI) [dkt. 18], and motion for partial summary judgment on Counts II and V [dkt. 19]. The parties have fully briefed the motions. The Court finds that the facts and legal arguments are adequately presented in the parties’ papers such that the decision process would not be significantly aided by oral argument.
