One issue is presented by this appeal: Did the trial court err in granting a summary judgment of dismissal against the plaintiff, Clyde Sample, a tenant’s invitee, in favor of a lessor upon the ground that such invitee was collaterally estopped by the result of his earlier action against a tenant?
