ON CONSIDERATION WHEREOF, IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that the judgment of said District Court be and it hereby is AFFIRMED.
This is a class action brought pursuant to the federal securities laws. The consolidated amended complaint alleges that Duane Reade, Inc. (“Duane Reade”), which operates a large chain of drug stores in the New York metropolitan area, violated Section 10(b) of the Exchange Act, 15 U.S.C. § 78j(b), and Rule 10b-5 promulgated thereunder, 17 C.F.R. § 240.10b-5.
