MEMORANDUM AND ORDER
MAGNUSON, District Judge.
INTRODUCTION
This matter is before the court on cross motions for summary judgment. The court has previously ruled on plaintiff’s motion for a temporary restraining order and a preliminary injunction. By order dated June 19, 1991, this court granted plaintiff’s motion for a temporary restraining order, thereby restraining the Counties from enforcing the Designation Ordinances until a hearing on a motion for a preliminary injunction could be held.
